This privacy policy sets out how Pulse Orb Inc. collects, uses and protects any information that you give to Pulse Orb when using the Pulse Orb App or web site.
Pulse Orb is committed to protecting your privacy. When you give us certain information while using our App you can be assured that it will only be used in accordance with this privacy policy. However, because we want to give you the best Pulse Orb experience possible, and because of the pace of technological change, including new devices and improved methods for designing Apps, we may change this privacy policy from time to time, without notice to you. Be sure to check back periodically to see if we've revised our privacy policy.
2. What We Collect
Pulse Orb may collect the following information from you when you download the Pulse Orb App and when you use the App:
- Your name
- Your e-mail address
- Your phone number
- Your geo-location
- Dates on which you accessed the Pulse Orb App
- Your device's unique I.D., the type of device you used to access the App, and information about your device such as which OS it uses
- Information about how you use the Pulse Orb App
- Information you provide to us when you ask for help or when the App doesn't work properly, such as crash reports
- Information related to advertising links you click
3. What We Do With the Information We Collect
Pulse Orb requires this information to understand your needs and provide you with an App that is customized to your needs, and in particular for the following reasons:
- To allow the app to fully function such as saving your progress state
- To provide you with access to relevant ads
- Internal record keeping
- To improve our products and services and to improve the App experience
- To develop new and exciting apps for you to enjoy
We may use the information to customize the Pulse Orb App and ads according to your interests.
4. How Long Do We Keep the Information We Collect?
We will retain your data for as long as you use the Pulse Orb App and for a reasonable time thereafter. If you would like us to delete the data you provided to us via the Application, please contact us at support@pulseorb.com and we will respond in a reasonable time. Please note that some or all of the User Provided Data may be required in order for the Application to function properly.
5. Do We Give Third Parties Access to This Information?
We will share your information with third parties only in the ways that are described in this privacy statement.
We may disclose your information:
- To our advertisers;
- As required by law, such as to comply with a subpoena, or similar legal process;
- When we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a valid government request;
- With our trusted services providers who work on our behalf, do not have an independent use of the information we disclose to them, and have agreed to adhere to the rules set forth in this privacy statement.
We do not sell or otherwise distribute your email or phone number. We do not collect your credit card information.
6. How Can I Opt Out of Allowing Pulse Orb to Collect and Use This Information?
You can easily stop all collection of information by the App by uninstalling the Pulse Orb App. You may use the standard uninstall processes that may be available as part of your mobile device or via the mobile application marketplace or network. You can also request to opt-out via email, at support@pulseorb.com; however, if you continue to use the Pulse Orb App after requesting an opt-out via email or if you re-install the App, we will regard this as consent to re-initiate data collection and use of that data in accordance with our then-existing privacy policy.
7. Security of Your Data
Pulse Orb is concerned about safeguarding the confidentiality of your information. We provide physical, electronic, and procedural safeguards to protect the information we process and maintain. For example, we limit access to this information to authorized employees and contractors who need to know that information in order to operate, develop or improve our Application. Please be aware that, although we endeavor to provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches.
8. Consent to Collection and Use
By using the Pulse Orb App, you are consenting to our collecting and processing of your information as set forth in this Privacy Policy now and as amended by us. "Processing" means using cookies on a computer/hand held device or using or touching information in any way, including, but not limited to, collecting, storing, deleting, using, combining and disclosing information, all of which activities will take place in the United States. If you reside outside the United States your information will be transferred, processed and stored there under United States privacy standards.
Users may request deletion of their account and associated personal information by contacting the Pulse Orb support team.
9. Permitted Users
The Pulse Orb application and website are not intended for use by children under 13 years old. No person under 13 years old may use the Pulse Orb application or access the website. If we learn that personal information has been collected from children under 13 years old without verified parental consent, we will delete that information promptly.

I. Acceptance of Terms
By registering for and/or using the Pulse Orb application or accessing the Pulse Orb website in any manner you agree to these Terms and Conditions and our Privacy Policy. Certain of the services may be subject to additional terms and conditions specified by us from time to time; your use of such Services is subject to those additional terms and conditions, which are incorporated into these Terms of Service by this reference.
Pulse Orb may amend these Terms of Service at any time by posting the amended Terms of Service on the Pulse Orb web site. Any amendment to these Terms of Service shall be effective automatically upon posting.
II. About the Pulse Orb Application
Pulse Orb is a fast-paced, skill-based mobile game where players tap the screen to keep a glowing orb bouncing across reactive ripple pads. As players survive longer:
- Speed increases
- Visuals intensify
- Rewards improve
Core hook: "One tap. One miss. Run it back."
The Pulse Orb application is designed to be used for entertainment only.
Pulse Orb may change, delete, update, or modify the gameplay, appearance, rewards, orb skins, events, and other featured items at any time.
Virtual items, cosmetics, and in-app purchases have no real-world monetary value. All purchases are non-refundable except where required by law.
III. Collection and Use of Personal User Information; Privacy Policy
For information about Pulse Orb's policies and practices regarding the collection and use of your personally identifiable information, please read the Pulse Orb Privacy Policy located here. The Privacy Policy is incorporated by reference and made part of these Terms of Service. By agreeing to these Terms of Service, you also agree that your use of the Pulse Orb application and website are governed by the Pulse Orb Privacy Policy in effect at the time of your use.
IV. Acceptable Use
The Pulse Orb application and website are not intended for use by children under 13 years old. No person under 13 years old may use the Pulse Orb application or access the website.
You must not use the Pulse Orb application or website in any way that causes, or may cause, damage to the application or website or impairment of the availability or accessibility of the application or website; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.
You must not use the Pulse Orb website to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, root kit or other malicious computer software, or any illegal materials.
You may not use the Pulse Orb application or website in any of the following manners:
- Cheating
- Exploits
- Use of automation / macros
- Hacked clients
- Any leaderboard manipulations other than ordinary game play
- Any violation of these Terms of Service
Any violation of the Acceptable Use policy or these Terms of Service may and will result in Pulse Orb suspending or terminating your account.
V. No Warranties
The Pulse Orb application and website are provided "as is" without any representations or warranties, express or implied. Pulse Orb Inc. makes no representations or warranties in relation to this website or the information and materials provided on this website or as to the appropriate use of, or quality of, the Pulse Orb application or website.
Pulse Orb does not guarantee continued availability of any game mode, feature, cosmetic item, leaderboard, or online service.
VI. Limitations of Liability
Pulse Orb Inc. will not be liable to you (whether under contract, torts or otherwise) in relation to the contents of, or use of, or otherwise in connection with, the Pulse Orb application or website:
- for any direct loss;
- for any indirect, special or consequential loss.
These limitations of liability apply even if Pulse Orb Inc. has been expressly advised of the potential loss.
VII. Trademarks and Intellectual Property
Pulse Orb Inc., the "Pulse Orb" name, the Pulse Orb logo, the Pulse Orb code, the Pulse Orb appearance and interface, and other Pulse Orb marks, graphics, logos, scripts, and sounds used in the application and website are trademarks and copyrights of Pulse Orb Inc. None of the Pulse Orb trademarked or copyrighted materials may be copied, downloaded, distributed, or otherwise exploited without the express written permission of Pulse Orb Inc.
VIII. Limitation of Liability — Damage Disclaimer
THE PULSE ORB SERVICES AND APPLICATION ARE PROVIDED "AS IS" AND WITHOUT WARRANTY OF ANY KIND EXCEPT AS STATED ABOVE, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, AND ANY WARRANTIES IMPLIED BY ANY COURSE OF PERFORMANCE OR USAGE OF TRADE, ALL OF WHICH ARE EXPRESSLY DISCLAIMED. PULSE ORB INC., AND OUR SHAREHOLDERS, DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS, DO NOT GUARANTEE THAT THE RESULTS OF USING THE SERVICES WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS OR WILL RESULT IN A PARTICULAR OUTCOME FOR YOU. YOUR USE OF THE PULSE ORB APPLICATION IS SOLELY AT YOUR OWN RISK.
UNDER NO CIRCUMSTANCES SHALL PULSE ORB INC., AND ITS SHAREHOLDERS, DIRECTORS, OFFICERS, EMPLOYEES, INDEPENDENT CONTRACTORS AND AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE OR EXEMPLARY DAMAGES (EVEN IF THAT PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), ARISING FROM BREACH OF THESE TERMS, SUCH AS, BUT NOT LIMITED TO, PERSONAL INJURY, LOSS OF REVENUE OR ANTICIPATED PROFITS, OR LOST BUSINESS OR BUSINESS OPPORTUNITY, OR LOST OPPORTUNITY OF ANY KIND.
ALL AVAILABLE FORMS OF DAMAGES AND ALL REMEDIES YOU MAY HAVE AGAINST PULSE ORB INC. ARE DISCLAIMED.
CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, FEES AND EXPENSES, LOSSES, AND CAUSES OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, EXCEED THE AMOUNT PAID BY YOU TO US FOR THE SERVICES WE PROVIDED TO YOU.

PULSE ORB INC. MAKES NO WARRANTY, AND DISCLAIMS ALL WARRANTIES, TO ANY OTHER PERSON OR ENTITY OTHER THAN THE PERSON OR ENTITY THAT PURCHASED THE PULSE ORB APPLICATION. ALL AVAILABLE FORMS OF DAMAGES AND ALL REMEDIES ANY SUCH THIRD-PARTY MAY HAVE AGAINST PULSE ORB INC. ARE DISCLAIMED.
IX. Jurisdiction for Disputes
Any disputes arising out of your use of the Pulse Orb application or website must be first brought to our attention so that we may attempt to amicably resolve them. In the event that the dispute cannot be resolved, you agree that the next step to resolving the dispute shall be through binding arbitration using a North Carolina court-certified arbitrator / mediator as agreed upon by the parties.
If we cannot agree to a mutually acceptable arbitrator, you agree that both you and Pulse Orb shall choose an arbitrator, and that those two arbitrators shall choose a third arbitrator. This panel will then hear and decide the dispute by at least a 2/3 vote.
In the event that one arbitrator is chosen, you and Pulse Orb agree to split the arbitrator's fees and costs equally. In the event a panel of arbitrators is used, you will pay in full the fees and costs of the arbitrator you chose, and Pulse Orb will pay in full the fees and costs of the arbitrator it chose, and you and Pulse Orb will split the third arbitrator's fees and costs equally.
The arbitrator or the arbitrator panel may award attorney fees to the prevailing party in any arbitration.
The arbitration award shall be enforceable in any court. The court for enforcing the arbitrator's award shall be that state or federal court having jurisdiction over matters occurring in Buncombe County, North Carolina, as that is where Pulse Orb has its headquarters.
